GENERAL TERMS AND CONDITIONS

The following General Terms and Conditions regulate the contractual relationships between the guest (hereinafter the “Customer”) and Kenekita, with registered office in Via Gallura, 10C, 07026 Olbia SS, Italy, VAT number 02789830904 (hereinafter the “Company ”) following the booking and payment of the accommodation chosen from those present on the portal www.kenekita.it (hereinafter the “Site”) concluded remotely directly or indirectly, via any mobile device, via e-mail or by telephone. Kenekita is a property management company, i.e. an entity that operates professionally in the management of properties and/or accommodation of third-party owners with the aim of leasing them for purposes other than housing, with particular reference to the tourism sector. At the same time, Kenekita is a company that provides additional services during the stay of its Customers, such as the supply of linen and cleaning of the rooms, assistance in the event of breakdowns or malfunctions of the property's equipment, the promotion of experiences on the territory. The following general conditions regulate the terms and conditions of the agreement between the Company and the Customer who books and purchases the services provided by Kenekita through the Site. The short or transitory rental contract having for object is the chosen accommodation stipulated between the Customer and the Company which, as an agent with the relevant power of representation, acts in the name and on behalf of the owners of the accommodation, thus generating contracts whose legal effects are directly attributed to them. pursuant to the art. 1388 cc The customer is required to accept these General Conditions and Terms of Use regulating Kenekita's services as well as the preliminary phase to the signing of the rental contract which will be responsible for regulating the relationship between the Customer and the owner of the accommodation in order duration, price, applicable taxes and the regulations governing the stay. The customer is therefore required to fully read the General Conditions and Terms of Use as well as any particular conditions applicable to individual services, made available on the Site before making a booking as well as, during the subsequent check-in phases. line, to read the short-term rental contract and its attachments beforehand. When confirming a booking or purchasing a service offered by the Company, by ticking that you have read this document, you automatically accept the General Terms and Conditions described here. The Company highlights that the acknowledgment check on the Site prevents the continuation of the booking in the subsequent steps. The General Terms and Conditions may be modified by the Company unilaterally and at any time, without notice, it being understood that such modifications will not be applied to orders placed by the Customer before such modification.

Booking Method

The online booking platform accessible from the Kenekita website allows the Customer to view and consult the real-time availability and prices of the accommodation managed by Kenekita. If the chosen accommodation is free for the selected period, to conclude and confirm the booking the Customer must pay the amount shown in the order summary by credit card following the guided instructions. Upon successful completion of the payment, the Company will send the Customer a Booking Confirmation email containing details of the amount paid, the duration of the stay, the number of occupants as well as any additional services.

Rates and Payment

The accommodation rate is indicated in the order summary and must be understood as including not only the rental fee, but also the costs of cleaning and ancillary services provided by Kenekita, gross of any tax or legal fee. For rentals of less than a month, the total amount must also include energy and gas consumption, heating and water, waste tax and condominium charges. The balance of the amount of the stay for the period indicated will have already been paid in full by the Customer to the Company at the time of booking via credit card payment or must be paid before check-in. Furthermore, the rate does not include any damage caused to the property or to the movable property that supplies it by the Customer whose repair and/or restoration costs have been predetermined by Kenekita, in the main interest of the Customer, in a specific list.

Cancellation of Reservations

The methods for canceling reservations are indicated on the Kenekita website. In case of cancellation or modification after the indicated terms, the reservation can no longer be refunded. Non-refundable rates cannot be changed and require prepayment of the entire stay. In case of no-show of the customer at check-in, the total amount of the reservation will be charged. Any request for modification of the reservation is subject to approval and availability by Kenekita and upon communication via email or telephone request to the Company's reservations office.

Discipline of Check-in and Check-out

The customer must confirm the check-in time according to the methods indicated in the Booking Confirmation email. At the time of check-in, the Customer gives the Company's representative the identification documents for identification to the security bodies. The Customer undertakes not to accommodate a greater number of people than that indicated in the Booking Confirmation. The return of the keys is mandatory according to the methods that will be communicated at check-in.

Security Deposit

When required, upon delivery of the keys, the Customer pays the security deposit. This will be returned to the Customer at the end of the stay, after the termination of the Contract, without prejudice to the Company's right to retain the deposit in the event of confirmed damage to the accommodation.

Modification of the Reservation

Kenekita reserves the right to propose the replacement of the accommodation with another of equal or higher quality if necessary. The change of booking is confirmed with the Customer's consent, which can be communicated expressly or tacitly. In the event of lack of accommodation of the same value as that booked, the Company may ask for a price supplement, subject to the Customer's consent.

Rules for Staying in the Accommodation

The Client undertakes to use the accommodation responsibly and to respect the rules of the structure and the condominium, if applicable. It is forbidden to use the accommodation for illicit acts and to disturb the neighbors. Failure to show the required identity documents or exceeding the maximum number of occupants allowed may lead to a ban on access to the accommodation. Furthermore, unless authorized in writing, it is forbidden to house animals and smoke inside the accommodation. The Customer is responsible for separating and disposing of waste according to local indications.

Reservations Over 30 Days

For reservations longer than 30 days, Customers must send an explicit request through Kenekita's corporate contacts. The rates for these reservations are non-refundable and require advance payment of the first month's rent, the security deposit and initial and final cleaning, plus any agreed upon extras. The reservation is confirmed only with the signing of the Rental Agreement.

Penalties & Limitation of Liability

The short-term rental contract contains an annex with the predetermined costs for any damage caused to the property or movable property. In the event of damage, Kenekita may retain the security deposit and request compensation for any further damage. The Company is not responsible for theft suffered by the Customer or for innocent interruptions of services.

Complaints and Contact Details

For information or complaints, Customers can contact Kenekita by e-mail, telephone or at the registered office in Via Gallura, 10C, 07026 Olbia SS, Italy. The Company will respond to complaints within 30 days of receiving them.

Processing of Personal Data

The Customer authorizes Kenekita to communicate his personal data in relation to contractual obligations and to fulfill legal information obligations. The data controller is Kenekita, with registered office in Via Gallura, 10C, 07026 Olbia SS, Italy, VAT number 02789830904.
